TERMS & CONDITIONS IIHF ESPORTS FAN CHAMPIONSHIP

1. Provider, Scope of application

1.1 Provider IIHF, Brandschenkestrasse 50, P.O. Box 1817, 8027 Zurich, Switzerland (hereinafter "IIHF") is the provider of the web portal http://esports.iihf.com (hereinafter "web portal") and organiser of the associated virtual ice hockey competition "2023 IIHF eWorld CHAMPIONSHIP" (hereinafter also referred to as "eWM event" or "tournament").

1.2 Scope and agreement. The terms and conditions below and those set forth in the rules of a tournament should be read in full before you participate as a player in tournaments on the web portal. By registering on the web portal and then each time you register for the eWM Event, you as a player ("You" or "Player") accept these Terms and Conditions and any additional terms and conditions that apply to the particular tournament. Players who reject or do not accept these Terms and Conditions, and any Additional Terms including all tournament rules, will not be allowed to register and will not be allowed to play.

1.3 Use without registration. Users who do not wish to participate in the eWM event can use the web portal to a certain extent without registration, but will still be subject to the relevant Terms and Conditions contained herein.

1.4 Changes. IIHF may change these Terms and Conditions at any time. IIHF will inform you of any changes. Using the web portal or continuing to play after the changes become effective means that you agree to the new Terms and Conditions.

2. Registration and Participation

2.1 Registration web portal. In order to participate in a tournament, you have to register on the web portal. The registration is free of charge.

2.2 Registration tournament. If you are registered on the web portal, you can register and play in tournaments. In addition to these Terms and Conditions, the special tournament rules ("Rules") and other conditions for the tournament apply, which you accept by registering for the tournament.

2.3 Privacy Policy. To register, you must provide some information. Please make yourself familiar with our Privacy Policy before you register. Please note that you can provide a lot of information voluntarily and that you can choose which of your details are visible to other players.

2.4 Suspension or termination of a tournament. IIHF reserves the right to interrupt or terminate a tournament at any time without notice. IIHF is especially entitled to do so if a proper execution of the tournament can no longer be guaranteed for technical, legal or economic reasons and/or does not seem reasonable.

 

3. Conditions of participation and your obligations as player

3.1 Technical requirements. To participate in the eWM event, a sufficient internet connection is required, as well as the availability of the competition equipment (the console or PC, monitor, controller, software, registrations with the manufacturer of the console, etc. required by the conditions of participation). For participation in the play-off phase and the finals (after successful qualification at the country-specific tournaments) it is necessary that the qualified player makes his matches available to the IIHF via livestream. The following applies: Advertising, in particular on clothing, is not allowed unless it is not dominant and does not contradict advertising measures of IIHF. Please contact the IIHF in case of doubt.

The players themselves are responsible for the existence of these technical requirements and the execution of the online games. Players must also observe and comply with the rules and regulations of the eWM event. In this context, it is pointed out that the IIHF has standardized special regulations for the case that a game cannot be played due to unacceptable latency periods.

3.2 Right to participate. Eligible to register on the web portal and to participate in eWM events are all natural persons who have reached the age of 16 years and are permanently resident in one of the 16 participating countries or national associations. A player can only register for the qualification tournament of a participating country of which he/she is a citizen (e.g. a Finnish citizen can only register for tournaments organised by the Finnish federation). In this context, attention is expressly drawn to the more specific explanations, justifications and further provisions contained in the Tournament Rules ("Rules"), which must be read before participation and are to be considered an integral part of the Terms & Conditions.

3.3 Correctness of the information. The player is responsible for the correctness of the data he/she provides (e.g. e-mail address, age). The player undertakes to update his entered player data and other details as they change. Each online participation in the eWM event requires a separate registration independent of the initial registration. Wrong data or missing registration can lead to exclusion, even from tournaments that have already started.

3.4. Reporting of irregularities. Any manipulations or irregularities of which players become aware must be reported immediately, no later than three (3) days after the end of a tournament. Complaints received after this time will not be considered, except for reports of cheating or indications of other crimes.

3.5 No disclosure. You may only use your access to the web portal yourself and you may only participate in the tournaments yourself. In particular, you are not allowed to pass on your account or registration data to others or to let others use them or to let others or a computer/bot play for you.

3.6 No infringing contents. No player who participates in a tournament may upload, display or communicate in any way messages or content that is racist, obscene, derogatory, punishable by law, or otherwise unlawfully infringes the rights of the IIHF or any third party (in particular of EA Sports) or is of a promotional nature. This also includes the possible violation of picture (also avatars), name and/or trademark rights of third parties as well as moral values of the IIHF.

 

 

4. Venue of the event

The tournaments take place online.

 

5. Costs

5.1 Participation is free of charge. The use of the web portal and the participation in the eWM event is free of charge.

5.2 Service charges. Participation in the eWM event can cause costs for you, e.g. costs for game console, internet connection, software.

 

6. IIHF Contact

If you have agreed to receive informational/promotional material from the IIHF by clicking the corresponding option during registration, we will occasionally send you information about events or news related to the IIHF, especially in the field of virtual ice hockey. If you do not wish to receive this information/promotional material, you can unsubscribe at any time by sending an email to privacy@iihfoffice.com and we will remove you from the list. The IIHF will contact you to keep you informed about developments and events of the IIHF. You don't have to agree to recieve IIHF information/promotional material to register or participate in an eWM event.

 

7. Rights of use

7.1. Rights holders. For the execution of the competition, IIHF uses the services of eSport Studio GmbH & Co.KG, Ganghoferstr. 68, 80339 Munich, Germany (hereinafter "eSportStudio"), which has licensed the NGL-software of the eSportStudio tournament system to IIHF. IIHF or/and "eSportStudio" and/or other licensors are the sole owners of all rights to the eSportStudio tournament system and the web portal, including the rights to software, texts, images, photos, logos, trademarks, videos, trade secrets, intellectual property and all other rights that have arisen and arise from the development and operation (notwithstanding clause 7.2 of these Terms and Conditions) of the system ("Content"). Without prior written permission from IIHF or the eSport Studio (as far as its rights are concerned) you are not entitled to change, copy, reproduce, sell, rent, use, supplement or otherwise exploit this content.

7.2 Your right of use. IIHF grants you a non-exclusive, non-sublicensable and non-transferable right to use the web portal and the information and contents provided there to the extent necessary for the purpose pursued by IIHF in making them available and transferring them, i.e. the operation of the web portal and the holding of eWM events.

7.3 Your granting of rights. By uploading data, documents, pictures, videos or information to the web portal or by publishing games and moves ("Uploads") you grant the IIHF the non-exclusive, transferable and sublicensable right to use these Uploads for its own business purposes, in particular for the operation and promotion of the web portal or the IIHF, as well as for media coverage of the eWM event. This also applies to the live streams.

The right to publish the matches covers live and post-match coverage on television, internet, social media and other channels. IIHF has the right to use all game results for the purposes mentioned here. By registering for the web portal and the respective tournament by the player, the IIHF has the right to publish the respective tournament and game results by naming the player's name and likeness (himself or through advertising, sponsoring partners, etc.) and to use and market them for commercial purposes.

7.4. CONSENT TO THE PUBLICATION OF RECORDINGS

In the event of winning a qualifying tournament and/or the entire event, IIHF may make recordings of the game, sound recordings, photographs and films ("recordings") of you.

 

YOU AGREE,
(i) that the IIHF is granted the exclusive, transferable and sublicensable right to use these recordings for an unlimited period of time worldwide in all digital and analogue media for the coverage and marketing of the tournament, the sport and/or the IIHF (on all playback devices, in particular on the Internet, TV and social media; including without limitation streaming of our coverage of the tournament on the Internet, the production and distribution of video blogs about the tournament on the Internet as well as the production and publication/dissemination of advertising campaigns about the tournament and/or the IIHF) other marketing material related to the Tournament).

(ii) that IIHF has the right to edit these recordings, to add appropriate advertising (e.g. split screen) if necessary and to publish and archive the corresponding production in all languages (dubbing right) as described under (i).

The consent is voluntary. The consent can be revoked for the future at any time in writing or by e-mail to IIHF at privacy@iihfoffice.com. However, consent is irrevocable in the case of multi-person images (e.g. group shots), content that has already been used for the measures described in this section 7.4, and during as well as after the player has claimed the winnings, unless a balance of interests is clearly in favour of the player. However, refusal to consent or revocation will result in the player's participation in the competition being terminated.

The above consent is given without separate compensation.


8. Warranty

IIHF is only liable for maliciously concealed defects. IIHF is not responsible for loss of use, malfunctions and the like of the web portal, especially with regard to the availability of the competition software tools (online tournaments and the like), the function and system requirements of the software of the game publishers (game manufacturers). IIHF makes no warranty or representation regarding the quality, suitability, completeness or accuracy of information on the web portal or regarding the technical participation options.

9. Winners and Prizes

9.1. Prize notification and dispatch. Winners of any prizes ("Winnings") will be notified by e-mail and informed about the further modalities of prize redemption and prize handover. The prizes will be determined according to the established conditions (the specific conditions or prizes for a tournament etc. can be found in the tournament rules or notices of the corresponding eWM events) and will either be sent out within two (2) weeks after the end of the tournament or wil be available for pickedup onsite at the relevant IIHF event, unless IIHF decides to send them out later. Further, winners are independently responsible and personally liable for all taxes and similar fees imposed on the player in connection with the Tournament prizes.

9.2 Preventions. If a player cannot participate in the eWM-event (e.g. due to health reasons, etc.) and/or if the eWM-event is not feasible for other reasons, the right to win and the right to participate expires. There is no claim to payment of the prize value. A cash payment of the prize is excluded. The prize will not be shipped or the claim to the prize will not apply if the prize is subject to a certain age limit according to the regulations for the protection of minors and the winner has not reached this age limit. The claim to the prize shall also lapse if the winner does not contact IIHF within five (5) days of notification and/or the winner cannot be contacted using the data provided. In this case IIHF reserves the right to nominate the player with the next placement. Prizes and eligibility are not transferable. IIHF is not liable for the loss of a prize when it is sent.

10. Terms

10.1 Termination of use by players. The player may stop using the web portal at any time and delete his account, e.g. by a corresponding action on the web portal or by sending an email to support@esports.iihf.com However, please note that your participation in eWM events or tournaments will end when you delete your account.

10.2 End of use by IIHF. Subject to 2.4 and 10.3 through 10.5, IIHF can terminate the respective registration contract with players (the registration on the web portal) at any time with a notice period of one (1) month in text form. If the player is registered for a tournament, the one-month period does not begin until the end of this tournament. IIHF can stop the operation of the web portal with a notice of three (3) months. No separate notice of termination by the player or IIHF is then required.

10.3 Serious infringement. The respective registration contract or the respective participation in an eWM event can also be terminated by IIHF for good cause if the player violates the Terms and Conditions in a substantial way as determined by the IIHF in its sole opinion or, in the context of the use of the web portal, violates applicable laws.

10.4 Extraordinary termination. The legal right of each party to extraordinary termination remains unaffected.

10.5 Suspensions. IIHF reserves the right to block, suspend, change, delete or add any player to the eWM event with immediate effect without any obligation to notify you if you violate these Terms and Conditions or the tournament rules.

11. Liability

11.1 Liability for damages. IIHF is only liable for damages caused intentionally or by gross negligence.

11.2. Exclusion of liability. Beyond this, the winner has no further rights due to material or legal defects in the prize or claims for damages.

11.3 Full liability in certain cases. The above limitations of liability in this clause 11 do not apply in cases of mandatory legal liability (e.g. under the Product Liability Act), nor do they apply in cases of injury to the life, body or health of the player.

12. Final provisions

12.1 Swiss law. Swiss law shall apply exclusively, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods.

12.2 Legal recourse is excluded. Legal recourse with regard to the organisation of the eWM event, the decision to win and the granting of prizes is excluded.
